Stokeshire Designer Doodles – Waiver of Liability, Assumption of Risk, and Non-Refundable Agreement
1. Parties and Purpose
This agreement (“Agreement”) is entered into between Stokeshire Designer Doodles, operated by Stokhaus Media LLC and referred to herein as the “Seller” or “Stokeshire,” and the undersigned “Buyer,” and applies to the purchase, training, care, and/or visitation of a dog (the “Dog”) bred or trained by Stokeshire.
By signing this Agreement, the Buyer affirms full understanding and acceptance of its terms and agrees that no verbal representations or prior understandings modify this contract.
2. Health Guarantee
The Dog is sold in healthy condition to the best of the Seller’s knowledge.
Common parasites such as giardia and coccidia are not covered under this guarantee.
The Buyer must obtain a licensed veterinary examination within 48 hours of possession.
Any serious congenital defect must be documented by the examining veterinarian and submitted in writing within 72 hours.
Exclusions: Umbilical hernias, retained testicles, cosmetic flaws, accidents, neglect, injury, or non-compliance with veterinary care requirements void all guarantees.
This guarantee is non-transferable and applies only to the original Buyer.
3. Premises Entry & General Liability Waiver
The Buyer voluntarily assumes all risks associated with entering Stokeshire premises or interacting with Seller’s dogs.
This includes risk of injury, illness, allergic reaction, bites, falls, livestock exposure, and property hazards.
The Buyer waives all claims against Stokeshire, its owners, employees, agents, and family members for personal injury, death, property damage, or loss arising during visits, pickups, deliveries, or events on or off-site.
Children must be supervised at all times. Pets brought to the property must be approved in advance.
4. Assumption of Risk: Dog Ownership
Buyer acknowledges that owning a dog carries inherent risks, including property damage, bites, allergies, behavioral unpredictability, and long-term financial responsibility.
Buyer agrees to indemnify and hold harmless Stokeshire from any legal claims, expenses, or damages resulting from the Dog’s behavior on or after the date of transfer.
5. Deposit & Refund Policy
All deposits and reservation fees are non-refundable under any circumstances, including but not limited to:
Buyer cancellation or change of plans
Allergy development
Inability to receive the Dog due to housing, timing, or finances
Dissatisfaction with gender, color, size, or temperament
Deposits may be transferred to a future litter only at the Seller’s sole discretion.
Final payment is due before or on the scheduled pick-up date. No Dog will be released without payment in full.
Failure to pay the remaining balance within 14 days of final invoice may result in forfeiture of both deposit and Dog.
6. Doodle School & Boarding Terms
Vaccination Requirements
Dogs entering training must have valid documentation for Rabies, Distemper, and Bordetella.
Titers are accepted but must be submitted in advance.
Vaccines must be administered at least 7 days prior to arrival for immunity to develop.
Care & Risk Waiver
Stokeshire exercises reasonable care, but is not responsible for:
Exposure to communicable diseases (including Kennel Cough)
Injury or escape during training or travel
Loss, illness, or death from natural causes or unforeseen events
Emergency Medical Authorization
In the event of a medical emergency, the Seller may seek veterinary care at its chosen facility if the Buyer or emergency contact cannot be reached.
Buyer is financially responsible for all medical expenses incurred, regardless of outcome.
7. Training & Behavior Disclaimer
Stokeshire does not guarantee specific behavioral outcomes (e.g., crate or potty training).
Every effort is made to support the Buyer with follow-up resources, but the Buyer accepts responsibility for continued training after transfer.
Behavioral regression, anxiety, chewing, barking, or leash-pulling are not grounds for refund or replacement.
8. Media Release
Buyer grants Stokeshire permission to use photographs, videos, or likeness of their Dog for marketing, educational, or promotional purposes in perpetuity without compensation.
9. Legal Jurisdiction, Disputes, and Enforcement
This Agreement shall be governed by the laws of the State of Wisconsin.
Any disputes shall be resolved exclusively in Taylor County, WI.
The Buyer agrees to binding arbitration in lieu of civil litigation.
In the event of any dispute, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
Class action waivers apply. Claims must be brought individually.
10. Acknowledgment & Entire Agreement
By signing below, the Buyer acknowledges:
They have read, understood, and agree to the terms stated herein.
This Agreement represents the entire understanding between the parties.
No oral statements, texts, or emails shall modify this Agreement.
